Article 1 – Seller identification

Article 2 – Purpose

These terms govern the sale of products offered on theramask.shop. Placing an order implies unreserved acceptance of them.

Article 3 – Products

The essential characteristics of the products appear on their respective pages. Photographs are as faithful as possible; slight variations in shade may appear depending on the screen and do not constitute a defect.

Théramask™ products are comfort and relaxation accessories. They are not medical devices and do not replace medical advice, diagnosis or treatment.

Article 4 – Prices

Prices are shown in Swiss francs (CHF) or euros (EUR) depending on the market, all taxes included. Delivery is free on all orders: no shipping charge is added to the price shown.

We reserve the right to change our prices at any time; products are invoiced at the price in force when the order is placed.

For deliveries outside Switzerland, customs duties and import taxes may apply. These are payable by the recipient.

Article 5 – Orders

The process is as follows: product selection, basket review, entry of contact details, choice of delivery method, payment, confirmation. Confirmation of payment concludes the contract.

By placing an order, you confirm that you are at least 18 years old, or that you have the authorisation of your legal guardian.

A summary email is sent to you. We reserve the right to refuse or cancel an order in the event of a previous dispute, suspected fraud or an obvious pricing error.

Article 6 – Payment

Payment is made at the time of ordering by card or by the methods offered at checkout. Transactions are secure and handled by certified providers. We never have access to your full banking details.

Article 7 – Delivery

Our products are shipped from China. Allow 1 to 2 working days for processing, then 10 to 20 days for transit. Full details are set out in our shipping policy, which forms an integral part of these terms.

The stated times are indicative. A delay does not give rise to cancellation or compensation, unless it exceeds 45 days from the order date: you may then request cancellation and a full refund.

It is your responsibility to check that your delivery address is correct.

Article 8 – Right of withdrawal and returns

You have 30 days from receipt to request a return. Return costs are payable by you, except for faulty, damaged or incorrect products. Full conditions are set out in our refund policy, which forms an integral part of these terms.

Article 9 – Statutory warranty

Products benefit from the statutory warranty against defects provided for in articles 197 et seq. of the Swiss Code of Obligations. Consumers in the European Union additionally benefit from the two-year statutory guarantee of conformity under Directive 2019/771.

Article 10 – Liability

We cannot be held liable in the event of misuse of the product, failure to follow the instructions supplied, or application to broken or irritated skin. Always check the temperature of the mask before applying it.

Our liability is limited to the amount of the order concerned, except in cases of gross negligence or wilful misconduct.

Article 11 – Intellectual property

All elements of the site — text, images, logo, the Théramask™ brand — are protected. Any reproduction without written authorisation is prohibited.

Article 12 – Personal data

The processing of your data is described in our privacy policy.

Article 13 – Applicable law and disputes

These terms are governed by Swiss law. In the event of a dispute, an amicable solution will be sought first: contact.theramask@gmail.com.

Failing agreement, jurisdiction lies with the courts of Corseaux, Switzerland. This clause does not deprive consumers residing in the European Union of their right to bring proceedings before the courts of their place of residence, nor of access to the European online dispute resolution platform.
